Uphaar Program - Terms and Conditions

PREAMBLE: These Terms and Conditions ("Agreement") govern the "Uphaar Program" ("Program"), a loyalty and rewards initiative offered by JK Cement Ltd., a company incorporated under the laws of India with its registered office at Kamla Tower, Kanpur-208001,(U.P) India and Corporate Office at Prism Tower, 5th Floor, Ninaniya Estate, Gwal Pahari, Gurgaon-122102, Haryana ("JK Cement"). This Program is extended by invitation only to select painters, contractors, tile applicators, and waterproofing contractors ("Partners"). Participation in the Program constitutes the Partner's full and unconditional agreement to and acceptance of this Agreement.
  1. GENERAL TERMS AND CONDITIONS
    1. Eligibility: Participation in the Program is restricted to Partners who have been formally invited and have completed the registration process as prescribed by JK Cement. The Program is non-transferable and is valid only for the registered Partner.
    2. Accrual of Points: Partners shall accrue loyalty points ("Points") based on their purchase of specified JK Cement products that are included within the purview of the Program during the designated scheme period. The quantum of Points awarded shall be as per the declared schedule for each product and Partner tier.
    3. Redemption of Points: The eligibility for redemption of accrued Points is contingent upon the total Points accumulated by the Partner within the ongoing financial year. Redemption of Points must be effectuated exclusively through the Partner's registered mobile number. The disbursement of rewards shall be executed in strict accordance with the redemption process and modalities established by JK Cement.
    4. Exclusivity of Program: This Program is an independent offering and may not be used in conjunction with any other promotional offers, schemes, or discounts provided by JK Cement, unless explicitly stated otherwise in writing.
    5. Disclaimer of Liability for Non-Receipt: JK Cement shall bear no liability for any claims, losses, or damages arising from the non-receipt of timely communications, non-crediting of funds to bank accounts, or failure by the Partner to collect or receive rewards, including but not limited to bank cards.
    6. Non-Transferability and Non-Negotiability of Rewards: All prizes, rewards, and benefits awarded under this Program are strictly non-transferable, non-assignable, and non-negotiable. They cannot be exchanged for cash or any other consideration.
    7. Third-Party Insurance: Any medical and/or accident insurance provided as a benefit under this Program is underwritten and administered by a third-party insurance company. The Partner's rights and obligations concerning such insurance shall be governed exclusively by the terms, conditions, and exclusions stipulated in the policy document issued by the said insurance company. JK Cement acts merely as a facilitator and is not the insurer.
    8. Right of Modification or Termination: JK Cement reserves the absolute right, at its sole discretion, to alter, amend, modify, suspend, or terminate the Program, or any part of this Agreement, at any time and without prior intimation to the Partners.
    9. Limitation of Liability: To the maximum extent permitted by law, JK Cement, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage whatsoever that may be suffered by a Partner as a result of their participation in the Program or the use, misuse, or non-use of any associated gift or reward.
    10. Governing Law and Jurisdiction: This Agreement and any disputes arising out of or in connection with the Program shall be governed by and construed in accordance with the laws of the Republic of India. The parties hereby submit to the exclusive jurisdiction of the competent courts in Delhi, New Delhi, for the resolution of any such disputes.
  2. COMMUNICATIONS, MARKETING, AND PROMOTIONS
    1. Express Consent to Communication: By accepting these terms, the Partner provides explicit and informed consent to receive marketing and promotional communications from JK Cement, its affiliates, and authorized third-party service providers. Such communications may be delivered via telephone calls, SMS, electronic mail (email), and instant messaging applications (e.g., WhatsApp) and will pertain to the Uphaar Program and other products or services of JK Cement.
    2. Purpose of Communication: Outbound communications shall be effectuated for the following express purposes:
      1. Administration of Benefits: For the collection and processing of personal data necessary for the administration of Program benefits, including the issuance of insurance policies and other entitlements afforded to Partners.
      2. Logistics and Dispatch: To obtain and verify communication addresses for the purpose of dispatching rewards, prizes, or other materials to which Partners are entitled.
      3. Performance Management: To communicate with Partners regarding their performance and status in ongoing promotional campaigns, including reminders concerning eligibility criteria and notifications of campaign deadlines.
      4. Program Engagement: To engage with Partners who are dormant or have demonstrated inconsistent participation, for the purpose of encouraging re-engagement.
      5. Program Information: To disseminate information concerning updates, modifications, or critical announcements related to the Program's features, functionalities, or terms.
      6. Event Invitations: To extend invitations to Partners and their families for events sponsored by or related to JK Cement.
      7. Product Marketing: For marketing and disseminating information related to new or existing products offered by JK Cement's various divisions.
      8. Data Management: To facilitate the secure collection, verification, and updating of Partner information as required for program administration and legal compliance.
      9. Service Improvement: To confirm the delivery of rewards and solicit feedback for quality assurance and service improvement purposes.
      10. Inquiry Resolution: To respond to and provide updates on inquiries, grievances, or requests initiated by the Partner.
    3. Revocation of Consent: The consent granted herein shall remain valid until expressly revoked by the Partner. A Partner may revoke this consent at any time by contacting the Uphaar Call Centre at 1800-103-7375 and formally requesting the cessation of all outbound promotional communications. Notwithstanding such revocation, JK Cement reserves the right to contact the Partner for transactional or non-promotional purposes.
    4. Call Recording: The Partner acknowledges and agrees that all telephonic communications with the Uphaar Call Centre may be recorded for the purposes of quality assurance, personnel training, and regulatory compliance.
  3. HEALTH & WELLNESS BENEFITS
    1. General Provisions: All health and wellness benefits, including insurance and tele-consultation services, are subject to the terms and conditions of the third-party service providers. Eligibility and activation are contingent upon successful registration.
    2. Insurance Claims: The claims process, including timelines for intimation and document submission, shall be governed by the specific terms of the insurance policy. Failure to adhere to the stipulated process may result in the rejection of the claim.
    3. Tele-consultation Process: The medical tele-consultation service is facilitated by JK Cement through a third-party provider. The process for availing this service must be followed as instructed. JK Cement is not a provider of medical advice or services.
  4. INTERNSHIP OPPORTUNITY
    1. Disclaimer: The internship opportunity is not an offer of employment or a guarantee of an internship position. It is solely an opportunity to apply and be considered for an internship. The final selection is at the sole discretion of the JK Cement HR department and is based on the candidate's merit, performance in the selection process, and suitability for the role.
  5. TRAININGS & CERTIFICATIONS
    1. Enrollment and Fees: Enrollment in any training or certification program is subject to availability and the Partner's expression of interest. Applicable fees must be paid within the stipulated timeframe to confirm registration.
